Kagebu Terms of Service

Article 1 (Application)

  1. These Terms of Use (the "Terms") set out the conditions of use for the Kagebu one-time purchase package (the "Product") provided by Emocute Lab. (the "Company").
  2. By purchasing, downloading, or using the Product, the purchaser (the "User") is deemed to have agreed to all provisions of these Terms.
  3. A User who does not agree to these Terms must not download or use the Product.

Article 2 (Definitions)

  • Product: the ZIP package "Kagebu v1.x," which includes a persona-building and operation framework for Claude Code (22 personas bundled), the 5-layer theory documents, the session protocol, and related materials.
  • Persona prompts: the AI persona texts in Markdown (.md) format provided by the Product.
  • Care personas: the four personas MX (pharmacology aide), PS (psychologist), HB (day shift), and YB (night shift).
  • Watermark: a unique identifier embedded in the Product text to identify the purchaser.
  • Sales channel: this site (emocutelab.com; payments are processed by Stripe).

Article 3 (Purchase and Grant of License)

  1. By purchasing the Product through this site, the User is granted a non-exclusive license to use the Product under these Terms.
  2. The license is limited to the individual purchaser or to a small business to which the purchaser belongs (an organization of 10 people or fewer).
  3. Transfer, resale, or sharing with third parties is prohibited.

Article 4 (Fees and Purchase)

  1. Price: the amount stated on the Product page of this site (consumption tax included).
  2. Payment method: credit card payment via Stripe.
  3. Billing form: a single payment (one-time purchase). No monthly or annual recurring billing is performed.
  4. Refunds: due to the nature of digital products, refunds are not provided as a general rule. However, exceptional conditions such as file corruption or material defects are governed by the Refund Policy.

Article 5 (Permitted Scope of Use)

The User may freely use the Product within the following scope.

  1. Loading and running the persona .md files in the User's own Claude Code or similar environment.
  2. Continued use for the User's own work, creative activities, or organization of thought.
  3. Copying to the User's own devices or environments (for backup purposes).
  4. Summarizing, critiquing, or quoting based on the content (within the requirements for quotation under copyright law).

Article 6 (Prohibited Acts)

The User must not do any of the following.

  1. Reselling the Product.
  2. Reproducing or publishing the Product (including posting its full text on GitHub, blogs, social media, etc.).
  3. Creating or selling a competing prompt collection using the Product.
  4. Using the Product as AI training data (including the Product text in a training dataset).
  5. Removing, disguising, or tampering with the watermark.
  6. Any use that violates these Terms, copyright law, or public order and morals.
  7. Using the Product as a substitute for medical, legal, or financial advice (see Article 7 in particular).

Where a violation of items 1 through 5 of Article 6 is confirmed, the Company may claim damages and report the matter to the payment provider (Stripe) and take legal action.

Article 7 (Conditions of Use for Care Personas)

  1. The care personas (MX/PS/HB/YB) are not a substitute for medical professionals or counselors; they are tools that assist in organizing thought.
  2. The User must not use the care personas for medical diagnosis, self-directed changes to prescription medication, as a substitute for emergency medical care, or for treatment.
  3. If the User senses an acute crisis, the User has a duty to promptly contact a professional institution (in Japan: 119, the Lifeline at 0570-783-556; in the United States: 988, etc.).

Article 8 (Intellectual Property Rights)

  1. The copyright in the persona prompts, the 5-layer theory documents, the session protocol, and the MANIFESTO belongs to the Company.
  2. By purchasing the Product, the User is granted a license to use it within the scope of Article 5 of these Terms.
  3. The copyright in content (code, text, music, etc.) generated by the User using the Product belongs to the User.
  4. Purchasing the Product does not transfer the copyright in the persona prompts themselves.

Article 9 (Anti-Copying Measures and Watermark)

  1. To deter unauthorized distribution of the Product, the Company embeds a purchaser identification hash (a one-way hash of the purchaser's email) into the Product text using zero-width spaces and similar techniques.
  2. Removing, disguising, or tampering with the watermark constitutes a violation of Article 6, item 5.
  3. If the source purchaser of a leaked Product file is identified from the watermark it contains, the Company may claim damages and refuse future purchases.
  4. The watermark does not contain the purchaser's name or email address itself; only an irreversible hash is stored. For details, see the Privacy Policy.

Article 10 (Updates)

  1. The Company provides the Product under version control (SemVer).
  2. Updates within the v1.x range (v1.0 → v1.1 → v1.2 ...) are provided free of charge to existing purchasers.
  3. Major updates (such as v2.0) are treated as new products, and existing purchasers may be offered a separate discounted price.
  4. Critical fixes relating to security or integrity are provided free of charge regardless of version.

Article 11 (Disclaimer of Warranties)

  1. The Product is provided "as is." The Company does not warrant the completeness, accuracy, or fitness for a particular purpose of the Product.
  2. Use of the Product separately requires Claude Code (Anthropic), whose operation, fees, and privacy policy are governed by Anthropic's terms.
  3. The Company is not liable for any damages arising from the User's use of the Product (including mental harm, harm to health, economic loss, LLM usage fees, etc.).

Article 12 (Limitation of Liability)

  1. The Company's liability shall in all cases be capped at the amount the relevant User actually paid to purchase the Product.
  2. The Company is not liable for indirect damages, lost profits, or special damages.

Article 13 (Amendment of Terms)

  1. The Company may amend these Terms. The amended version will be distributed as the terms bundled with the next version of the Product.
  2. For Users who continue to use an existing version, the terms in effect at the time of purchase continue to apply.

Article 14 (Governing Law and Jurisdiction)

  1. These Terms are governed by the laws of Japan.
  2. The Kumamoto District Court shall have exclusive jurisdiction as the court of first instance for any dispute relating to the Product.
